Terms for using the Neighborly Harvest marketplace.

These terms explain the roles, responsibilities, and limits that apply when customers, farms, and visitors use Neighborly Harvest.

Platform Role

Neighborly Harvest is a technology marketplace and platform that helps customers discover local farms and, for eligible farms, may support checkout, pickup coordination, farmer delivery, and future Neighborly Harvest-managed delivery.

Independent farms, producers, and sellers are responsible for their own products, listings, prices, availability, claims, licenses, permits, labeling, food safety practices, pickup, delivery, fulfillment, and refunds caused by their products or fulfillment.

Unless we expressly state otherwise in writing for a specific service or product, Neighborly Harvest is not the producer, packager, manufacturer, farm, certifier, health advisor, inspector, or guaranteed seller of farm products.

Product Information and Customer Responsibility

Product information is provided by farms and producers. This may include product descriptions, photos, production practices, ingredient details, allergen information, pickup instructions, delivery windows, availability, and storage or handling guidance.

Customers are responsible for reviewing farm-provided product information, allergens, ingredients, storage instructions, pickup or delivery details, and availability before ordering. If information is unclear, customers should contact the farm or Neighborly Harvest before purchasing.

Accounts and Marketplace Use

You are responsible for providing accurate account information, keeping login credentials secure, and all activity that occurs through your account.

You may not misuse the platform, interfere with marketplace operations, submit misleading content, attempt unauthorized access, scrape the service at abusive levels, evade fees, abuse payments or refunds, or use Neighborly Harvest for unlawful products or activities.

Neighborly Harvest may remove listings, products, accounts, reviews, messages, or other content that creates legal, safety, fraud, payment, operational, or customer-risk concerns or that violates our policies.

Orders, Availability, and Fulfillment

Orders may be limited by customer location, farm inventory, farm availability, service area, payment status, delivery rules, pickup windows, weather, staffing, routing, and other operational constraints.

Starter farms may use Neighborly Harvest for free discovery-only listings and should not use Neighborly Harvest checkout unless they have been approved for eligible marketplace selling features.

Farmers are responsible for honoring the pricing, availability, pickup windows, delivery windows, and product details they publish, subject to reasonable corrections when inventory, safety, or operational issues arise.

Fees, Payments, Taxes, and Refunds

Neighborly Harvest may charge commissions, service fees, delivery fees, subscription fees, payment processing fees, or other marketplace fees as disclosed in the applicable checkout, dashboard, agreement, or policy.

Taxes, where applicable, may be calculated, collected, reported, or remitted by farms, Neighborly Harvest, payment processors, or other providers depending on the transaction type and legal requirements. Farms remain responsible for understanding their own tax obligations.

Refunds, cancellations, disputes, and chargebacks are handled based on the order status, product perishability, farm policy, delivery status, payment processor rules, and whether the issue was caused by the farm, customer, delivery failure, or platform error.

Third-Party Services

The platform may rely on third-party services for payments, infrastructure, email, analytics, maps, authentication, and support. Those services may have their own terms and privacy practices.

Payment processing is handled by payment providers such as Stripe. Neighborly Harvest does not claim to store raw payment card numbers on its own servers.

No Warranty

Neighborly Harvest is provided on an as-is and as-available basis. We do not guarantee uninterrupted access, error-free operation, complete accuracy of farm-provided content, product availability, delivery timing, or that every farm or product will meet every customer expectation.

We do not provide medical, nutritional, legal, tax, certification, inspection, or food-safety advice. Customers and farms should consult qualified professionals or regulators when needed.

Limitation of Liability

To the fullest extent allowed by law, Neighborly Harvest is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, loss of data, business interruption, or reputational harm arising from use of the platform.

To the fullest extent allowed by law, our aggregate liability for claims related to the platform will be limited to the amount paid to Neighborly Harvest for the transaction or service giving rise to the claim, or one hundred dollars if no amount was paid to Neighborly Harvest.

Disputes, Updates, and Contact

Please contact anthony@neighborlyharvest.com with order disputes, account concerns, or questions about these terms. We may ask for order details, photos, communications, and other information needed to review the issue.

We may update these terms as the marketplace changes. Continued use of Neighborly Harvest after an updated effective date means the revised terms apply going forward.
